1. About these terms

These Terms of Service (“Terms”) govern your access to and use of Rise English (“Rise English”, “we”, “us”), an online English learning service available at riseenglish.com.au and related applications (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

2. Who can use Rise English

The Service is designed for secondary-school students studying English. If you are under 18, you may only use the Service with the consent and supervision of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service.

3. Your account

You must provide accurate information when creating an account and keep your password secure. You are responsible for activity that occurs under your account. Please tell us promptly if you believe your account has been used without your permission.

4. Acceptable use

You agree to use the Service for personal, educational purposes only. You must not: share or resell your account; attempt to disrupt, reverse-engineer, or scrape the Service; submit unlawful, harmful, or abusive content; or misuse the AI feedback feature (for example, by submitting content that is not your own genuine work).

5. Subscriptions and payments

Some features require a paid subscription. Plans, prices and billing cycles (monthly or annual) are shown at the point of purchase and may change from time to time. Payments are processed by our payment provider (Stripe); we do not store your card details. Subscriptions renew automatically until cancelled, and you can cancel at any time through your account or billing portal. Access continues until the end of the paid period. Refunds are handled in accordance with Australian Consumer Law and our then-current refund practices.

6. AI feedback

The Service may offer AI-generated feedback on written work. This feedback is formative guidance to help you learn; it may be incomplete or occasionally inaccurate, and it is not a substitute for a qualified teacher or an official school assessment. Do not rely on it as a definitive mark.

7. Content and intellectual property

The Service, including its questions, lessons and design, is owned by Rise English and protected by law. You may not copy or redistribute it. Writing and responses you create remain yours; by submitting them you grant us a limited licence to process them to provide the Service (including generating feedback).

8. No official assessment; disclaimers

Rise English is a practice tool. Grades, levels and progress indicators are practice-based guides mapped to the Victorian A–E scale and are not official school assessments. The Service is provided “as is” without warranties of any kind to the extent permitted by law. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

9. Limitation of liability

To the maximum extent permitted by law, Rise English is not liable for any indirect or consequential loss arising from your use of the Service. Where our liability cannot be excluded, it is limited to re-supplying the Service or the cost of doing so.

10. Changes and termination

We may update the Service or these Terms from time to time; material changes will be notified through the Service. We may suspend or terminate accounts that breach these Terms. You may stop using the Service and close your account at any time.

11. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction.
